Take back the backyard | House Party Blog

My line of thinking about yard work had always been to keep it simple and ?let nature take care of it.? Pushing mowers, raking leaves and pulling weeds was not my idea of weekend fun. I was fine letting the elements take care of my yard. Unfortunately, the elements were beginning to take over?and it showed.

  • My wife?s complaining about it did nothing to change my point of view
  • The kids begging me to trim a little so they could play out back made me laugh
  • The fact that the dog refused to go in the grass didn?t faze me in the least

But what changed my mind about yard work was a picture. A picture left on the kitchen counter. One my wife took in our backyard.

That's MY backyard?!

That?s where I saw it ? my inspiration ? tucked away beyond the growing weeds, branches and tall grass, she had somehow found a little oasis that looked so beautiful, I had to ask her where she was when she took it.

When she told me it was our backyard ? at first I didn?t believe her ? then I had to go see for myself. And I began to see my yard in a different light and took great reverence in what I had and began to care for it like my neighbors did with pulsing mowers and humming leaf blowers.

And alas, my spring cleaning ritual started and has remained every year since seeing that picture. If you?re like me and are trying to return to yard work after a bit of a hiatus, here are my recommendations for getting back into it:

Go bagless
Find a place where yard waste can go back into nature and not into a bag. Choose a corner of your yard or a stretch of woods to dump it to make clean up much faster.

Grass was made for mulching
Get a mulching blade for your lawnmower and don?t even think about collecting grass in a bag.

OCD and spring cleaning don?t mix
Every leaf and branch does not have to be picked up for your yard or garden to look great. Do your best to get what you can quickly and easily, but don?t obsess.

Define boundaries
You might have trouble figuring out where a garden is, was or should be, but figure that out first if you?re planning on having one.

Celebrate your yard
Enjoy your yard and hard work with a picnic table, a simple and great way to enjoy it. You may even want to define an outdoor picnic area if your yard allows for it.

I?d love to know how all of you celebrate your yards. Post in the comments and let me know how your spring cleaning is going and what your plans for your yard are.

Legal Monopolies - J?rg Guido H?lsmann - Mises Daily

Before we deal with the impact of monopolies on the production of monetary services, let us emphasize that our argument concerns only legal monopolies. It does not concern economic monopolies ? market situations in which products and services have just one provider. Such economic monopolies are fairly common on the free market, and they are per se perfectly harmless. Typically, the economic monopolist is big enough to serve the entire market and can offer better conditions than any competitor. But this is not writ in stone. The characteristic feature of economic monopolies is that they are contestable. Everybody is free to cater to the same market and thus to "test" whether the current monopolist is really so good that nobody can withstand his competition. By contrast, legal monopolies prevent such testing because violations of the law are suppressed through the courts and police forces.[1]

In monetary affairs, we may speak of a legal monopoly whenever only some monetary products (possibly just one product) may be produced, but not any other similar products.

For example, the legal monopoly might provide that only silver may be used as money, or that only the bank X may offer checking accounts, or that only banknotes of the bank Y or coins of the mint Z may be used in payments.

Legal monopolies ? which we will call for brevity's sake "monopolies" ? entail inflation by the very fact that they shield the privileged products from competition. The monopoly makes the privileged products relatively less costly to acquire (in comparison to competing products) than they otherwise would have been. The market participants therefore tend to use more of them than they otherwise would have used; and as a consequence they also tend to produce more of them than would otherwise have been produced. This inflation works out to the benefit of the producers and first recipients of additional units of the monopoly product, and to the detriment of producers and users of alternative products, which would have been fabricated and used in the absence of those legal privileges. Thus we encounter again the phenomenon that fiat inflation (of the privileged monies or money certificates) goes hand in hand with fiat deflation of other monetary products.

Monetary monopolies are especially harmful when combined with legal tender laws. But even in the absence of such combinations, monopoly has certain baneful effects that are relevant for our present analysis of money and banking from a moral point of view. Let us first deal with monopoly bullion and then turn to monopoly certificates.

Monopoly Bullion

The government can decree that only one type of precious metal may be used in monetary exchanges and punish the use of all other metals. Or it might simply be the monopoly owner of all mints, and then decide to mint coins only in one metal.[2]

Such monopolies have for example been created in Germany and France after the war of 1870?71, when both countries adopted a gold standard and prevented the minting of silver coins (except as tokens for gold). It is true that the bullion monopoly in these cases went hand in hand with a coin monopoly. Still a pure bullion monopoly is conceivable. It creates a greater demand for the privileged metal and crushes the demand for all other metals. Thus we have here again the familiar double phenomenon of fiat inflation and fiat deflation.

Historically, the establishment of monopoly bullion has been an important step in the consolidation and centralization of national monetary systems under government control. The outlawing of silver paved the way to an inflation of fractional-reserve certificates backed by gold. The reason is twofold.

On the one hand, fractional-reserve certificates can be a vehicle for short-run adjustment to the fiat deflation of silver. With silver disappearing from circulation the market participants turn to the remaining alternatives such as gold. Because the gold supply cannot be easily extended, the increased demand would entail a drop of gold prices or, in other words, an increase of the purchasing power of gold. But this is a problem for those who operate on debts and who were not shrewd enough to anticipate the drop in prices. These people therefore turn to substitutes for gold that can be easily multiplied, such as the notes issued by fractional-reserve banks.

On the other hand, and quite apart from this short-run problem, silver is no longer available as a competitor for gold and thus money users have less possibilities to protect themselves against the inflation of gold-backed money substitutes. Moreover, it is for technical reasons impossible to replace silver coins with gold coins of the same purchasing power because in general the latter would have to be so small as to be impracticable. A case in point is the British quarter guinea, which was minted in the years 1718 and 1762 and each time failed to be generally accepted for monetary service. In such circumstances the silver currency is therefore not in fact replaced by a gold currency, but by a currency of gold substitutes. These substitutes might initially be fully backed by gold. However, as we have already argued, it is much easier to turn fully backed money substitutes into fractional-reserve substitutes than it is to debase coins. Hence, the doors are now wide open for inflation.

Monopoly Certificates

Virtually all the coins that have circulated have enjoyed a monopoly and were legal tender. Private coinage existed at a few times and places, but even then the definition of the proper coin sizes usually lay in the hands of government. An example is the early United States. Here coinage was largely private, but the US Constitution nevertheless reserved the privilege of defining weights and measures to Congress. It authorized Congress to send in the police against anyone producing or using coins other than the official ones. Thus there was no completely free choice in producing and using alternative coins. Certain coins enjoyed a legal monopoly ? monopoly coins.

Notice that monopoly coinage per se cannot entail inflation on any quantitatively significant level. This is most certainly so in the case of sound coins. But even in the case of debased coins, inflation is likely to be very limited. The reason is that monopoly privileges "merely" outlaw alternative monies or money certificates. They cut down the menu from which money users may choose, but they do not prevent them from evaluating the monopoly monies as they see fit. In the case of debased coins, this means that monopoly laws leave the people at liberty to distinguish between old coins (which contain more fine metal) and the new debased coins. There might then be two price systems or, if it proves to be too cumbersome to distinguish old and new coins in daily trade, the market participants might just as well decide to melt down the old coins or sell them abroad. It follows that there is no inflationary effect whatever (if anything, a slight deflationary effect is more probable).

From the point of view of the debaser ? the government ? the entire exercise is therefore more or less pointless. He might for some time manage to cheat his customers into thinking that no debasement is going on. But this deception cannot last for any considerable length of time. As soon as the market participants realize what is going on, they will buy and sell the new coins at different nominal prices, so as to leave the real exchange ratios (in precious metal weights) unchanged. No additional revenue can thus be gained for the debaser. This is of course the reason why debasement has never been orchestrated under the mere protection of monopoly privileges. In practice, debased government coins have always been protected by the additional privilege of legal tender laws.

Things are very similar in the case of certificates that are not physically connected to the monetary metal (in particular banknotes and demand deposits). They too can be produced on a free market. And in distinct contrast to coins, they actually have been produced under competitive conditions at many times and places in history. In the 19th century, most Western governments established banknote monopolies, which were granted to banks with especially close ties to the government. These banks operated on a fractional-reserve basis and created a considerable amount of banknote inflation. But just as in the case of debased coins, the monopoly alone was not the enabler of that inflation. The simple reason is, again, that the monopoly privilege merely suppresses competing products, but does not prevent people from evaluating the monopoly banknotes as they see fit. A banknote monopoly does not therefore prevent the market participants from rejecting these banknotes altogether and conducting their business only in coins (cash). Thus as in the case of coins, we must conclude that monopoly privileges for banknotes are inherently harmful and socially disruptive, but that their quantitative impact is likely to be rather small.

The Ethics of Monetary Monopoly

Our foregoing discussion did not shed any positive light on legal monopolies in money. Why, then, has monopoly been so widespread and longstanding in this field? One standard argument is that the control of the money supply is one of the prerogatives of secular government.[3] But this is of course not an argument at all, unless we equate government omnipotence with the welfare of the commonwealth. The question is why the certification of weights should be entrusted to government, and to government alone. One plausible answer to this question is that it is natural to trust government. Oresme argued quite succinctly that the princes were the natural leaders of society. It seemed only natural to confide the certification of gold and silver weights to the men who were trusted to make life-and-death decisions on behalf of all members of society. If they could not be trusted, who else could?

Even if we grant this deduction for the sake of argument, it is by no means clear that it can be readily applied to our times. The princes of the High Middle Ages personally led their armies into battle. There were therefore much better reasons to trust one's prince, who constantly pledged his own blood, than to trust the members of modern parliaments, who seldom are required to walk their talk.

But even if we concede, again for the sake of argument, that Oresme's deduction could be applied to the modern context, the deduction itself does not hold water. The only conclusion one could infer from the premise that governments are inherently trustworthy is that governments would tend to be successful in the money certification business. But it does not follow at all that only the governments should be allowed to enter this business. There is no reason why other people than the princes should not acquire a reputation of trustworthiness equal to, or even superior to theirs. It might be true that in medieval Europe the princes were the most widely trusted members of society. Other people might be most widely trusted at other times and other places. The point is that there is no reason at all to grant such people a monopoly and thus to shield them from competition. Few things are better known in economic theory than the baneful effects of monopoly. Coinage is no exception. As long as a minter lives up to his reputation of being honest and trustworthy, the monopoly is simply pointless, because people will use his coins anyway. But as soon as a formerly honest minter gives in to temptation and starts to cheat, his monopoly prevents other people from switching to the better services of other minters. Oresme acknowledged that such cheating was highly unworthy of public authority:

Also it is absurd and repugnant to the royal dignity to prohibit the currency of the true and good money of the realm, and from motives of greed to command, or rather compel, subjects to use less good money; which amounts to saying that good is evil and vice versa, whereas it was said to such from the Lord, by his prophet: Woe unto them that call evil good and good evil. [Isaiah 5:20][4]

Notice that this consideration not only applies to the case of a formerly honest monopoly minter who has fallen from grace. It applies to monopoly minting itself, because it necessarily involves "commanding, or rather compelling, subjects to use less good money" than they might be able to use if competition were free.[5]

Monopoly prevents people from using what is rightfully their property and thus prevents them from competing with privileged market participants. This is partial theft. If the government allows me to drive my car on all days of the week except for Sunday (for example, because the government itself wants to preserve the monopoly of transport services for that day) then it deprives me of the full use of my property. And I am similarly deprived of the full use of my legitimate property if I may not use it to produce money.

In light of these considerations, it should not be surprising that monopoly's bad press is hardly a fabrication of the classical economist and their followers, who stressed various utilitarian considerations against monopoly.[6] These authors could in fact build on the traditional ethical rejection of monopoly. From a biblical point of view, legal monopolies are condemnable because they violate the Eighth Commandment ("You shall not steal"). The ethical case against legal monopolies is simply an elaboration of this insight. As one historian of thought summed up 20th-century scholarship on medieval views,

The Scholastics did not oppose the free operation of the marketplace. On the contrary, the Scholastics ? related the just price to competitive market condition, castigated cartels and the activities of guilds to restrain trade, and had no intention of stigmatizing profits legitimately earned.[7]

According to a subtler argument for government monopoly in money, the government has the right to do to the money of the country whatever it wishes because at all times it owns the entire money supply. Thus the money that the citizens keep in their wallets and their bank accounts is not really their money. They are just stewards for the true owner: the government. The standard justification for this argument is the famous verse in Matthew 22:21. Here the Pharisees show Jesus a coin with Caesar's image and he commends them to "repay to Caesar what belongs to Caesar and to God what belongs to God." Some advocates of monopoly in money take this to mean that all coins belong to the government, in the present case to Caesar.

But this opinion is untenable, as the passage in which the verse appears clearly shows.[8] The passage reads,

"Tell us, then, what is your opinion: Is it lawful to pay the census tax to Caesar or not?" Knowing their malice, Jesus said, "Why are you testing me, you hypocrites? Show me the coin that pays the census tax." Then they handed him the Roman coin. He said to them, "Whose image is this and whose inscription?" They replied, "Caesar's." At that he said to them, "Then repay to Caesar what belongs to Caesar and to God what belongs to God." (Matthew 22:17?21)

Thus it was not just any coin that the Pharisees presented to Jesus, but a coin that was specifically used for the payment of taxes to the Roman Empire. Moreover, Jesus did not even say that the coin itself belonged to the government (Caesar); but only that those sums of money that were owed to the government (if any) were to be paid to it. Oresme too explicitly rejected the opinion that governments somehow are the inherent owners of the entire money supply. He placed great emphasis on this point:

But if anyone should say that ? certain commodities are the private property of the prince for which he may set his own prices, as some say is the case with salt and a fortiori with money, we answer that a monopoly or gabelle of salt, or any other necessity, is unjust. And that princes who have made laws to give themselves this privilege are the men of whom the Lord says, in the words of the prophet Isaiah: "Woe unto them that decree unrighteous decrees, and write grievousness which they have prescribed." [Isaiah 10:1] ? money is the property of the commonwealth.[9]

Is it licit to apply this argument in our modern context? Are democratically elected governments really quite on equal footing with the princes of the Middle Ages? As far as the present question is concerned, there is indeed no essential difference and Oresme's point applies today as it did in the 14th century. Democratic governments do not own their citizens. They do not own their citizens' money either.

[5] What we see here is that any advocacy of monopoly contradicts one of the most cherished principles of Catholic social doctrine, namely, the principle of freedom of association. It is true that 20th-century popes and the Second Vatican Council have defended this principle mainly in the context of the legitimacy of labor associations. But the principle itself extends far beyond that realm. Pope John Paul II made this crystal clear in a passage of Centesimus Annus (?7) in which he discussed Leo XIII's Rerum Novarum, where the same point had been made:

In close connection with the right to private property, Pope Leo XIII's Encyclical also affirms other rights as inalienable and proper to the human person. Prominent among these, because of the space which the Pope devotes to it and the importance which he attaches to it, is the "natural human right" to form private associations. This means above all the right to establish professional associations of employers and workers, or of workers alone. Here we find the reason for the Church's defence and approval of the establishment of what are commonly called trade unions: certainly not because of ideological prejudices or in order to surrender to a class mentality, but because the right of association is a natural right of the human being, which therefore precedes his or her incorporation into political society. Indeed, the formation of unions "cannot ? be prohibited by the State," because "the State is bound to protect natural rights, not to destroy them; and if it forbids its citizens to form associations, it contradicts the very principle of its own existence."

As Leo XIII had pointed out, this right is so primordial that it may only be qualified in the case of associations that are "evidently bad, unlawful, or dangerous to the State." (Leo XIII, Rerum Novarum, ?52.) But the State has no right whatever to prevent or dissolve any legitimate association. It follows that there is no moral basis, at any rate from a Catholic point of view, to prevent or dissolve associations of persons who wish to produce and use a specific kind of money.

News: Wellington College Pupils Triumph in Adult Chess League Top Division

A team of seven schoolboys from Wellington College have just scored an historic first in chess in the county.

The boys won the Berkshire Chess League Division 1, an adult league, with one game in hand. They played eight games and won eight. This is the first time any school has entered a team in this division, and the closest school is Eton in the lower half of division 2.

Unlike other clubs in the league who have titled players in their teams, Wellington?s pupils are not yet at that level although two of the players, James Holland and Brandon Clarke, are close to achieving this status of Master level.

The team are also into the last eight of the national schools competition, having secured wins over RGS Guildford and Reading Boys, who were last year?s finalists).

Wellington?s first team has been unbeaten by schools for 4 years. (Knocked out of national schools twice on age handicap).

The winning side were James Holland, Brandon Clarke, Akash Jain, Alex Galliano, Adrian Archer Lock, Alex Freeland and Ewan Wilson.

State Police Pursue Woman After Fraudulent Cancer Fundraiser

March 23, 2012 Updated Mar 23, 2012 at 7:08 PM EDT

As recently as last night, 27-year-old April Landis was thanking people on Facebook for attending her cancer fundraiser Saturday night. However, by that time, Candy Oliver, with the Steuben County Cancer Association was already having serious doubts about her story. Landis has been telling friends and family for a month that she has a rare brain cancer. Both she and her husband have numerous pictures posted online with shaved heads.

Among the many red flags was the fact the Doctor April named wasn't a cancer doctor. After collecting enough evidence, Candy called and confronted April.

"I told her this is a scam and I know it. She stated stuttering and I told her I've already spoken to police and that she should turn herself in because it's over, then I hung up", said Oliver.

The damage was already done, Saturday's fundraiser was a huge success, over a dozen people even shaved their heads to support the Mother of four in her battle against cancer. After the phone call with Candy, April did call police and turned in several thousand dollars from the fundraiser. Police say she offered no explanation and showed little emotion, now Angola and Indiana State Police fear not all the money is accounted for.

"we're trying to get a tally of how much is still out there, we'll return the checks that we can account for", said Detective Harry Nix with Indiana State Police.

April and her husband did not return our phone calls and no one was home when we stopped at their mobile home to question the about the cancer fundraiser.

April's Father was on Facebook today saying he was as surprised as anyone to hear the news. However, he was maybe not as surprised as Nancy Short. She was recently diagnosed with a very serious form of late stage cancer and spoke directly to April at the benefit, giving her $1,000 in cash. She was devastated after learning the news today.

"I'm angry, I didn't even think to see if she had a port. I don't know how someone can lie about something that's so personal to me and my family", said Short.

It's important to note, the Steuben County Cancer Association had no affiliation with Saturday's benefit, but played a key role in stopping the scam in its tracks. We found postings from April going back to last month talking about her battle with Cancer. Today, those same pages are filled, both with supporters and people livid that someone could take advantage of people in that way.

Police say they will return the checks, but it's up to the court to decide what happens to the cash. They'll recommend the money is given to what it was intended for: fighting cancer. As for April Landis, she is expected to face criminal charges soon from the Steuben County Prosecutor's Office.
If you gave any money for the benefit of Landis, you're asked to call the Angola Police Department at 260.665.2121

Jon Hamm Slams Kim Kardashian Again!

Incredibly, hilariously, and totally awesomely, Jon Hamm is apparently at it again.

In an interview with Time Out London, the actor was asked about his status as a sex symbol and told the publication:

“The sexy thing is so ephemeral and meaningless other than in the world of selling magazines. Who cares, when it's reduced to just that? You might as well be a Kardashian and have a sex tape.”

Yes! Burn!

A Total HammKardashian, Kim

This dig, of course, follows Hamm's reference to Paris Hilton and Kim Kardashian as "idiots" who serve as examples of how stupidity is rewarded in our culture. He's mostly stuck by these comments, too.

Jonathan Cheban (we know: who?!?) also upped the ante this week by saying his friend is more popular than the multiple-time Emmy winner.

Whose side are you on in this feud?

Cross-cultural Leadership in the Implementation of Systems ...

Ika Safitri Windiarti (Defence and Systems Institute (DASI), University of South Australia)

Projects are often performed by people from diverse cultural backgrounds. The ability of engineers to manage and work in these cross-cultural teams includes cross-cultural leadership ability. Cross-cultural leadership competence for the engineers supports the quality of the project performance.

In this research we conduct a web survey addressing the perception of cross-cultural issues in the implementation of SE processes in projects. Several questions investigated the engineers? knowledge, experience, and perception of how they manage their intercultural relationship related to cross-cultural leadership.

Elements of Systems Engineering Processes

The international standard describing the systems engineering processes associated with the system lifecycle is ISO/IEC 15288. This standard is used as the basis of the INCOSE (International Council on Systems Engineering) Systems Engineering Handbook, which in turn is the foundation of the INCOSE systems engineering certification program(Windiarti, Ferris, and Berryman 2011b).
ISO/IEC 15288 divides the processes to support the system lifecycle into four groups: agreement; organizational project-enabling; project; and technical processes.

Indonesian Expatriate Engineers? Cross-Cultural Leadership Experience

All the participants were in a culturally diverse environment. Those who had familiarity with a multicultural work environment found that cross-cultural adaptation in their workplace was not a major challenge for work performance. They found that the multicultural team helped them to complement each other to improve project achievement and quality. In some cases the limited cross-cultural ability of engineers may reduce project performance rather than lead to improvement. What is leadership? Leadership is a role of influencing group of people or organization in terms of task and objectives, commitment and fulfillment of target achievement, group/organization identification and culture (Yukl 1989). Cross-cultural leadership is basically applying the leadership assignment in the multicultural work environment. General duty of the leader is to manage the achievements of the project goal and manage job distribution among the team member under leader?s authority. In cross-cultural leadership, power distance which was one of the Hofstede?s cultural dimension is take an important role (Hofstede 1983). The relationship between leader and follower is influenced by the perception about power distance based on their cultural background.

Conflict Management in the Multicultural Work Team

A 45.79% of the respondents answer that the project leader was resolving the conflicts that may occurred in the multicultural project team by using existing rules written in the project guidelines. This reveals that most of the project leaders preferred to make a judgment in the multicultural working environment based on existing rules rather than considering the cultural background of the team members. This result reflects a different result than was obtained in the pilot study, where conflict resolution was based on the uniqueness of each individual. The difference would appear to result from the survey requiring selection of a single response in contrast to the free-form response permitted in the interviews.

Decision Making in Multicultural Work Team

The research participants were asked about how the team members contribute their ideas to the leader?s decision in risky situations. Based on the accumulated answer, option D that decision is always made by collaboration of leader?s and members? ideas was being the most chosen among the research participants. Given the combined options, we found that the important decisions in the project team were made collaboratively, combining the leader?s ideas and members? contribution in analyzing the supporting ideas.

Completeness and perfection of the project vs relationships between the team members

The research participants were asked an open-ended question about which one is the most important thing for their organization.?Sixty nine answered that the completeness and perfection of the project is the most important thing for the organization. These engineers explained why they chose this option. In this survey a number of engineers explained their reason that the most important thing in the project is achieved project goal. Other reason was that the objective of the company or project is to make profit from the production and services. Some of the research participants are expatriate engineers who work based on the contract. Their job mainly accomplishing project?s target in a certain country (within the same company) and they will relocate to other country for other different project. This circumstances caused the engineers chose the relationship between team members is less important that completeness and perfection of the project.

In this question, 135 engineers answered that the most important thing in the organizations is the relationship between team members. Some of the research participants explained that good relationship among team member support the productivity of the team project in achieving project goal. As been discussed in previous section, in this part, cross-cultural leadership skills also become important in a project related with the importance of team relationship. The last reason is because a solid teamwork can be formed and with this solid teamwork the project will run well and the objective can be achieved.

From the survey result, 84 engineers answered that a combination of completeness and perfection of the project and relationships between the team members is useful for the project or organization.
Conclusions

This paper reports that as perceived by Indonesian engineers, the conflicts the project team was mostly resolved based on existing rules rather than considering the cultural background and the important decision in the project team was made by collaboration of leader?s ideas and member?s contribution in analyzing the supporting ideas. Other result from this study is that the relationships between team members were being the importance to the organization rather than the project completeness and perfection.

Engineers suggested that a combination of completeness and perfection of the project and relationships between the team members is valuable for the project or organization in implementing SE processes and their implication on the improvement of cross-cultural leadership capability.
Finally, for the future work, the diversity in project team allowed an appropriate cross-correlation analysis between background (experience, demographic, and type of industry) and the finding from this research in cross-cultural leadership or other topic.

AJC Spring 2012 Dining Guide | Food and More with John Kessler

(Our interactive map makes it easy to find an ?Atlanta 50? restaurant near you.)

The last time I summoned the sheer chutzpah to propose a list of metro Atlanta?s top 50 restaurants, the year was 2004. Back then many of the best restaurants were also the most ambitious ones. Scouting out the talented chefs who used top-tier ingredients meant going to a lot of places with tablecloths and ice-filled wine buckets.

That hierarchy has collapsed, and I have to say it makes this quest a lot more rewarding. Today you can eat great food in scores of casual joints, in bars where you shout over head-banger music, in revitalized neighborhoods throughout the metro area, in farmers markets and at food truck rallies.

Review by John Kessler

John Kessler is the chief dining critic for The Atlanta Journal-Constitution

All across Atlanta, I have witnessed the doctrine of manifest yumminess.

So how do you choose 50 from this bounty?

You eat and eat, and eat some more. But first you must decide what doesn?t belong.

I chose to stay away from restaurants outside the metro area (sorry, Athens) and restaurants that only serve late at night (like Octopus Bar) or on weekends (Quinones at Bacchanalia).

I avoided some very good places that suffer from inconsistency and others that are too similar to better spots nearby. I tried as best as I could to provide a variety of styles and cuisines.

I?m still looking for a French, Thai or Middle Eastern spot to merit a place on this list. I?m sorry to the worthy Italian and Japanese restaurants that were edged out.

I did not limit it to only those places that we?ve rated three stars and above but instead made room for two-star restaurants ? such as Roswell?s Table & Main and Lilburn?s Three Blind Mice ? that add so much to their communities and connect so well with their fans. It?s not an ITP or an OTP thing, it?s a looking-like-Atlanta thing.

Some restaurants that I had not previously rated, but have visited at least twice, now get a rating.

Two previously rated places got a bump. Atlanta?s Heirloom Market BBQ deserves three stars as a citywide destination for its inimitable fusion barbecue. Miller Union has grown into a defining restaurant for today?s Atlanta and it deserves a fourth star. (A guide to our star ratings and a list of the restaurants we?ve rated.)

No restaurant on this list lost a star. Yay!

I hope you enjoy this list and can use it as a guide when you travel throughout metro Atlanta. As you can see, there?s lots to explore.

Nikon D800 studio samples posted at DPReview (update: 5D Mark III studio sample added)

Image
Nikon faced some backlash following the announcement of its D800 DSLR, due both to the camera's potentially excessive 36.3-megapixel resolution and its relatively limited top sensitivity of ISO 25,600. Then, less than one month later, Canon revealed its own mid-range full-frame cam -- the 5D Mark III -- with a 22.3-megapixel sensor, and an option to shoot at ISO 102,400. Both models appeal to the same market of professional photographers, but with vastly different specs, which is the better pick? Low-light shooters will likely base part of that decision on high-ISO capabilities, and after reviewing samples from both cameras, there appears to be a winner.

DPReview spent some time with the D800, and we took the Canon for a spin last week. We scaled the D800 sample down to 22.3 megapixels to match the 5D, then pasted a 300-by-400 1:1 pixel section from each camera side-by-side in the image above. The D800 JPEG (on the left) appears to be the noisier of the two, which seems logical, considering that Nikon opted to boost the camera's resolution instead of its sensitivity. Still, the cam's top-ISO is quite usable, and if you plan to shoot in a studio setting or can live without a six-digit sensitivity, the D800 will likely suit you just fine. Hit up our source link for samples shot at the full ISO range, including full-res downloads, to make that call for yourself.

Update: We've replaced the Canon sample with a studio shot from DPReview, which provides a more accurate comparison. You can find images from both cameras at our source links below.

Court wary of life without parole for juveniles

The Supreme Court is debating whether young teenagers convicted of killing someone may be locked up for life with no chance of parole, the latest in a line of cases seeking a second chance for young people. (AP Photo/Evan Vucci, File)

(AP) ? The Supreme Court appeared ready Tuesday to say anew that young people who commit even the most brutal crimes should not be punished as harshly as adults, taking up a pair of cases in which 14-year-olds convicted of murder are serving life sentences with no chance of parole.

The latest in a line of cases asks whether young teenagers facing the rest of their lives in prison deserve the possibility of a second chance. In recent years, the court has ruled out the death penalty for juveniles and life without parole for young people whose crimes did not involve killing.

Roughly 2,300 people are behind bars for life with no chance of winning their freedom for crimes they committed before their 18th birthday. Seventy-nine of them are in prison for crimes that took place when they were 14 or younger.

The precise contours of an eventual ruling were not apparent after arguments Tuesday, but several justices said they were troubled by the way some states try and sentence young people accused of crimes.

Justice Anthony Kennedy raised the lack of flexibility in sentencing young killers. Several states that try people younger than 18 in adult courts allow for only one sentence, life with no chance of parole, for defendants who are convicted of murder.

Kennedy seemed to indicate he might favor a ruling that gives judges a role in determining an appropriate sentence, "that the sentence cannot be mandatory, but that in some cases it might still be imposed."

He wrote the earlier opinions holding juveniles less responsible than adults when their sentences are considered. He seemed again to be the pivotal justice in Tuesday's arguments.

Bryan Stevenson, the lawyer for both defendants, tried to resist Kennedy's approach, preferring an outcome that would force states to consider parole at some point for anyone with a life sentence who was convicted before turning 18.

Stevenson said the court has previously recognized that it is a "mistake to equate kids with adults. And we don't have the ability to make those judgments even if we create a different kind of process."

Allowing an inmate to be considered for parole doesn't mean it will be granted, Stevenson said. In Nevada, for example, an inmate convicted of murder has to serve 20 years before getting a parole hearing, he said.

Arguing for Alabama before the justices, state Solicitor General John Neiman Jr. said the court should respect the decisions of Alabama, Arkansas and 37 other states that allow children to be tried and punished as adults.

"Imposing life without parole sentences on aggravated murder offenders like Evan Miller is in line with the national consensus, is morally justified and is consistent with legitimate penological goals," Neiman said.

Neiman said the court already has drawn a line between crimes involving killing and those that don't.

Kennedy also asked both sides for statistics on how often people who are imprisoned at a young age show that they have been rehabilitated.

But Justice Antonin Scalia, who dissented in earlier juvenile sentencing cases, scoffed at the notion.

"Well, I thought that modern penology has abandoned that rehabilitation thing, and they no longer call prisons reformatories or whatever, and punishment is the criterion now. Deserved punishment for crime," Scalia said.

The court has a range of options if a majority decides to limit states' sentencing powers:

?The court could issue a blanket ruling that applies to everyone under 18.

?It could set a younger cutoff age, as both defendants at the high court were 14.

?The justices also might throw out mandatory sentences but still allow judges to impose life without parole once they consider the circumstances of the crime and the defendant's background. On that point, several justices pointed to the apparent difference in the culpability of the defendants in the two cases.

The court should decide the cases by early summer.

The cases are Miller v. Alabama, 10-9646, and Jackson v. Hobbs, 10-9647.
